1. HOW TO ENTER: Compose an essay of not more than 250 words with the theme: “Why our fire station is the hardest working fire station in America." 

Include with your essay a separate title page with the complete name, address,  phone number, Fire Station Number, Station address, and the Number of firefighters at the station,  as well as an e-mail address (if applicable) for the fire station.  Limit one entry per fire station.  All entries will become the sole property of Living Essentials and will not be returned.

Essays may be submitted either digitally at www.5HourFireStation.com or by mailing. Essays which are submitted digitally must be received by 11:59 P.M. ET, September 30, 2009. Mailed submissions must be postmarked on or before September 30, 2009.

Living Essentials is not responsible for technical failures in entry transmission, or lost, late, misdirected, damaged, incomplete, illegible, or postage-due mail, or any damager to participants’ computers relating to information about or participation in the promotion. Living Essentials reserves the right to cancel any electronic method of entry if it becomes technically corrupted. 

2. ELIGIBLITY:  The contest is open only to fire brigades, companies, or similar units of firefighters (whether volunteer or municipal) serving in the 50 United States of America. The prize will be awarded to those firefighters who are working in the fire station at the time the prize is awarded. Employees of Living Essentials, its advertising and promotion agencies, and their immediate family members and/or those living in same household are not eligible, even if the firefighter is in an eligible brigade, company or similar unit.  

3. JUDGING: All essays will be reviewed by a panel of 3 anonymous judges appointed by Living Essentials.  Judging will be based on the following criteria, with a numerical score applied to each of the three categories:  

In the event that there is a tie, the winner shall be randomly drawn from all tied entries.

On or about October 30, 2009, the winning fire brigade, company or unit will be notified by phone, mail and/or e-mail at the location based on the contact information submitted.  In the event that the winning brigade, company or unit cannot be notified, fails to respond to the notification within the time period allowed by the notification, or the notification is returned as undeliverable, they will be disqualified and the next highest scoring essay will be deemed the winner.

4. PRIZE:  Five Hundred and Fifty Five (555) bottles of 5 Hour Energy liquid energy shots will be awarded to the winning fire brigade, company or unit of firefighters.  Approximate retail value of the prize:  $1,500.  The prize is not transferable, cannot be redeemed for cash and must be accepted as awarded.  In the event the prize cannot be awarded as stated, Living Essentials may substitute a prize of equal or greater value in its sole discretion.  The winners may be asked to execute an Affidavit of Eligibility/Release of Liability and Publicity within a time period specified in the winner’s notification certifying that the entry is the fire brigade or company or other similar unit of firefighters. Non-compliance within this time period may result in disqualification and the next highest scoring essay will be selected as the winner.  All entries are subject to verification.

By accepting a prize, the winning organization agrees to release Living Essentials and its parent companies, subsidiaries, affiliates, related companies and advertising and promotion agencies, and each of their respective officers, directors, employees and agents from any and all liability, loss or damage of any kind arising out of or in connection with their participation in this contest or with respect to awarding, receipt, possession, use and/or misuse of the Prize.  Living Essentials is not responsible for any typographical or other errors in the printing, the offering or the announcement of any prize of the promotion.  

All federal, state and local taxes are the sole responsibility of the winners.  All federal, state and local laws and regulations apply.

5.  GENERAL RULES: By submitting an entry, all entrants agree to be bound by these Official Rules and the decisions of the judges as final and binding in all matters related to this contest.  All federal, state, and local taxes are the sole responsibility of winners. All federal, state, and local laws and regulations apply.  Void where prohibited.  All entries must be original works that have never been previously published, and must not infringe on any third party rights. The winning entrants assign all copyrights to Living Essentials.  By submitting an entry, entrants grant permission to Living Essentials and its agencies to use the entrants’ names and/or likenesses and the exclusive right to publish, edit and/or copy the entry for any and all purposes in any media (including but not limited to print and digital media) for purposes of advertising/trade, without further compensation to entrants unless prohibited by law.  If any provision of these Official Rules is found to be invalid or unenforceable by a court of competent jurisdiction or appointed arbitrator, such determination shall in no way affect the validity or enforceability of any other provision therein.  Any claims relating to this contest shall be governed by Michigan law without regard to its conflict of law rules, and any such claim must be heard in Michigan.
